By accessing, browsing and using our website and/or by completing a reservation or taking accommodations at one of our properties, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below:
TERMS AND CONDITIONS
By making a reservation or taking accommodations at any of our properties, you agree to enter in to a SHORT-TERM ROOM RENTAL AGREEMENT between YOU (THE GUEST) and LA ROOM RENTAL and/or LA BOARDINGHOUSE (THE HOST), and acknowledge to have read, understood and agreed to the terms below.
SHORT-TERM ROOM RENTAL AGREEMENT:
1) TERMS: This is a fixed-term Rental Agreement between THE GUEST and THE HOST that begins on the CHECK-IN DATE and ends no later than 11am on the CHECK-OUT DATE of the reservation, at which time THE GUEST must vacate and shall immediately and peacefully surrender and return to THE HOST the possession of the leased premises.
2) INSURANCE: THE GUEST must maintain their own Insurance to cover any losses sustained to their personal property, vehicle or expenses relating to the necessity to relocate or any other losses. THE HOST does not maintain this insurance to cover personal property damage or relocation expenses caused by fire, theft, rain, infestation, water overflow/leakage, acts of GOD, and/or any other causes. It is acknowledged that THE HOST is not liable for these occurrences. It is acknowledged that the guest's insurance policy shall solely indemnify the guest for any losses sustained. GUEST's failure to maintain said policy shall be a complete waiver of GUEST's right to seek damages against THE HOST for the above stated losses. The parties acknowledge that the premises are not to be considered a security building which would hold THE HOST to a higher degree of care.
3) ARBITRATION OF DISPUTES: ANY DISPUTE BETWEEN THE PARTIES ARISING FROM OR RELATING TO A CLAIM FOR PERSONAL INJURY, WHICH IS DIRECTLY OR INDIRECTLY RELATED TO, OR ARISING FROM A CONDITION OF THE LEASED PREMISES OR THE COMMON AREAS, OR ANY EVENT THEREON, SHALL BE RESOLVED SOLELY BY ARBITRATION CONDUCTED BY THE AMERICAN ARBITRATION ASSOCIATION. Any such arbitration shall be held and conducted in the county in which the premises are located before three arbitrators, who shall be selected as follows: The claimant and respondent shall each select one arbitrator. The two selected arbitrators will then select a third arbitrator, and the three arbitrators shall constitute the panel. The provisions of the American Arbitration Association rules shall apply and govern such arbitration, subject, however, to the following: (a) Any demand for arbitration shall be made in writing and must be made within 180 days after the claim, dispute or other matter in question has arisen. In no event shall the demand for arbitration be made after the date that institution of legal or equitable proceedings based on such a matter would have been barred by the applicable statute of limitations. (b) The arbitrators’ jurisdiction extends to all punitive damages claims and call actions. (c) Each party shall bear their own respective fees and cost relative to the arbitration process, and attorneys’ fees, if awarded shall not exceed $500.00. (d) All administrative fees and costs, including but not limited to the arbitrators’ fees relative to the arbitration process must be advanced prior to the selection of the arbitration panel and shall be borne equally by all parties. (e) The decision of the arbitrators shall be final, and judgment may be entered on it in accordance with applicable law.
4)HOUSE RULES: THE GUEST agrees to follow the HOUSE RULES for the duration of the reservation. 1. The earliest check-in time is 4pm. All guests have to vacate their room by 11am on their check-out day. 2. Guests will be provided a set of clean sheets and a towel, which will be collected at check-out. There is a $20 fee for missing towels or sheets. 3. Children are prohibited from playing in the hallways or common areas. No children under the age of twelve (12) years are to be left unattended in the rental unit or on the grounds. 4. All complaints shall be made by sending an email to the host. 5.The illegal use, sale, or distribution of drugs, any criminal activity and/or any physical violence to persons or property by any Guest is prohibited. 6. The host assumes no responsibility for accepting deliveries of packages, mail, etc. on behalf of any Resident. 7. Guests are not allowed to have Visitors at the property. 8. Hallways and common areas are to be kept clear of clutter. No personal items may be kept or stored in the hallways, stairways, or other common areas in or about the premises. 9. Littering the grounds, landscaping and parking areas is strictly prohibited. This includes putting out cigarettes on the sidewalks and in driveways. 10. Guests shall keep the volume of musical instruments, radios, etc. at a level that will not disturb other residents. Playing sound producing devices at volumes that disturb other Residents is a prohibited. Quiet hours are between 10pm and 7am. Quiet hours apply to all areas of the House including the patio and parking lot. 11. Public areas and stairs shall be used exclusively for entrance and exit of the premises. Guests shall not use such areas for loitering and shall not store any trash, junk, or valuables outside of the building or in hallways or porches. 12. No Pets are allowed. 13. Guests are responsible for the proper and safe disposal of their matches and cigarette butts, so as not to pose a fire hazard or litter the grounds. No smoking is allowed inside the house and in the covered patio areas. 14. Kitchen Access (only for reservations that include "Kitchen Access Privileges" in their booking confirmation): a. Only guests with Kitchen Access privileges are welcome to use the kitchen daily from 7am to 10pm. b. All dishes need to be washed, dried and put back to its place immediately after using them, and any mess or spills on the kitchen counters or stove need to be cleaned up immediately. c. Any guest, who fails to do so, will lose kitchen access privileges. 15. While using our Wifi network, illegal downloads and online activities that violate US Copyright Law or any other law are strictly prohibited.
